As a service provider to Hunter UK, it is essential that you commit to the following:

DRUG AND ALCOHOL POLICY CONSENT

I can confirm that I have been shown the Hunter UK Drugs and Alcohol Policy (D&A) and informed by Hunter UK of the requirements with regards to D&A pre-screening. operational and random screening tests.

In addition, I confirm that I have been made aware that, in the interests of safety, a condition of me providing services to Hunter UK and their end-clients is that I agree to such tests be conducted.

I understand that the test will be conducted by approved toxicology companies and appropriately trained Collection Officer's and that I will be given the opportunity to provide further consent prior to any test being carried out and will be provided with:
  • An explanation regarding the purpose of the test
  • What type of test will be conducted, i.e. breath, urine, oral etc.
  • The result of the test
  • A copy of the 'Chain of Custody Form
  • An opportunity to have a further test (Sample B) carried out, at my own expense, should I wish to contest the original result


I confirm that I agree, and give my consent, during my provision of services for Hunter UK, upon request, to participate in any drug and alcohol screening tests as required by Hunter UK and/or their client(s). I also give my consent that the results of any test conducted can be shared by Hunter UK with any nominated 3rd parties in accordance with Hunter UK and my GDPR consent agreement.

HUNTER UK-CLIENT DRUG AND ALCOHOL TESTING CONSENT FORM


I hereby agree, upon a request made under the drug/alcohol testing policy of Hunter UK, to submit to a drug or alcohol test and to furnish a sample of my urine, breath, and/or swab for analysis. I understand and agree that if I at any time refuse to submit to a drug or alcohol test under SLA agreement, or if I otherwise fail to cooperate with the testing procedures, I will be subject to immediate withdrawal of my services. I further authorize and give permission to have the Company, Alere (Abbot) Toxicology send the specimen or specimens so collected, to a laboratory for a screening test for the presence of any prohibited substances under the policy, and for the laboratory or other testing facility to release any and all documentation relating to such test to the Hunter UK and/or to any governmental entity involved in a legal proceeding or investigation connected with the test. Finally, I authorize Hunter UK to disclose any documentation relating to such test to any governmental entity involved in a legal proceeding or investigation connected with the test.

I understand that only duly-authorised Company officers, employees, and agents will have access to information furnished or obtained in connection with the test; that they will maintain and protect the confidentiality of such information to the greatest extent possible; and that they will share such information only to the extent necessary to make SLA decisions and to respond to inquiries or notices from government entities.

I will hold harmless Hunter UK, its company contracted business partners, and any testing laboratory & collection officer the Company might use, meaning that I will not sue or hold responsible such parties for any alleged harm to me that might result from such testing, including loss of work or any other kind of adverse job action that might arise as a result of the drug or alcohol test, even if a Hunter UK or laboratory representative makes an error in the administration or analysis of the test or the reporting of the results. I will further hold harmless Alere (Abbot) Toxicology, its Sample collection officer, and any testing laboratory that Alere (Abbot) Toxicology might use for any alleged harm to me that might result from the release or use of information or documentation relating to the drug or alcohol test, as long as the release or use of the information is within the scope of this policy and the procedures as explained in the paragraph above.

This policy and authorization have been explained to me in a language I understand, and I have been told that if I have any questions about the test or the policy, they will be answered.

I UNDERSTAND THAT THE VELOCITY DELIVERY SERVICES LTD WILL REQUIRE A DRUG SCREEN AND/OR ALCOHOL TEST UNDER THIS POLICY WHENEVER I AM INVOLVED IN ANY SERVICE-RELATED ACCIDENT OR INJURY UNDER CIRCUMSTANCES THAT SUGGEST POSSIBLE INVOLVEMENT OR INFLUENCE OF DRUGS OR ALCOHOL IN THE ACCIDENT OR INJURY EVENT. ALSO, I UNDERSTAND THAT I WILL BE SUBJECT TO RANDOM DRUG SCREEN AND/OR ALCOHOL TESTS UNDER THIS POLICY AND I AGREE TO SUBMIT TO ANY SUCH TEST.

Some of the information is regarded as sensitive data as defined in the DPA. The test result, any medical information you have disclosed and the reason for the test is of sensitive nature. The fact that you have been tested is not regarded as sensitive information.

As part of our contractual obligations to our clients any Hunter UK employees and contractors working or providing services at any client's sites will be subject to and must give their consent to adhere to the clients "Stop & Search Policy. The client's reserve the right to search you and/or any of your property when on its premises (including client car parks) and you agree that the client may search you and/or your property:
  • At any time, the client reasonably believes or suspects that you may be in possession of, have destroyed, tampered with, concealed or handled stolen goods or has evidence of any theft or attempted theft; or
  • If the client reasonably believes or suspects that you may have drugs and/or alcohol and/or other inappropriate items on their premises; or
  • As part of a random searching policy or process; or
  • When you enter or leave the client’s premises

Background


  1. The Company's business involves the resourcing and supply of self-employed suppliers and independent contractors specialising in the provision of multi-drop parcel delivery services, which the Company provides to its clients at various UK geographic sites and locations.
  2. The Supplier, as an independent person in business, in their own right, provides professional driver and multi-drop delivery/courier services ("the Services") and, such skills and abilities may, from time to time, be available to the Company.
  3. The Company and the Supplier agree that if the Supplier offers to make his services available to the Company and is engaged by the Company, the terms and conditions in this Contract for Services shall apply.

Operational Provisions


  1. Both parties agree and intend that if, and when, the Supplier agrees to provide services to the Company, he is engaged as an independent business in his own right under a contract for services and not a contract of employment or any other kind of contract.
  2. The Company is under no obligation to, and provides no guarantee it will, offer or provide the Supplier with any works whatsoever. The Supplier is under no obligation to accept any offer of works which may be made available by the Company or make his services available to the Company at any time. The Supplier is free to decline to provide any services at any time for any reason.
  3. The Supplier agrees that if he provides services to or on behalf of the Company, the Supplier shall:
  • Any liability arising from any employment-related claim or any claim based on worker status (including reasonable costs and expenses) brought by the Supplier or any Substitute against the Company arising out of or in connection with the provision of the Services;
  • Any personal injury claim made by a third-party road user and/or pedestrian arising from carrying out the Services;
  • Any accidental (or deliberate) loss or damage to Deliverables. The Company may at its option satisfy such indemnity (in whole or in part) by way of deduction from any payments due to the Supplier.

Miscellaneous


  1. The Supplier confirms that he has read and understood the terms and conditions contained within this contract for services and has had the opportunity to discuss this with any person or professional adviser he considers necessary before signing.
  2. Both parties agree this is intended to be a legally binding contract governing the nature of the contractual relationship between them.
  3. Both parties agree that these terms and conditions represent the whole agreement between them. No variations may be made to these terms unless agreed in writing by both parties.
  4. Should the Company fail to enforce or apply any of the rights that it has under this Contract for Services, it shall not be construed that the Company approves or agrees to any breach of contract or that it loses its rights to enforce the terms of this Contract for Services in full at any time now or in the future.
  5. The Headings used in the Contract for Services are for ease of reference only and are not intended to be interpreted as part of the terms agreed between the parties. References to the masculine include the feminine.
  6. This contract is governed by the laws of England and Wales.
